“Korean LMO Quarantine Procedures Too Strict”… US Industry Points Out Non-Tariff Barriers
In the wake of the Trump-led tariff war, ‘LMOs that can reproduce’ are gaining attention. On the 11th (local time), the Bioindustry Organization (BIO) submitted a statement to the Office of the United States Trade Representative (USTR) stating, “The review stipulated in Korea’s LMO law is dispersed across multiple agencies, which lacks transparency and predictability,” and “Korea’s special regulations are non-tariff barriers that have not been resolved for over 10 years.” It was confirmed that the United States Soybean Council (USSEC) also pointed out that “Korea is handling the export approval process for crops developed using biotechnology, such as gene-edited agricultural products, too strictly.” In order for genetically modified organisms (GMOs), including LMOs, to be imported and distributed domestically, they must undergo a risk assessment review and an import/distribution/use approval process in accordance with relevant laws. Each procedure is handled by seven ministries, including the Ministry of Agriculture, Food and Rural Affairs (for feed), the Ministry of Food and Drug Safety (for food and drugs), and the Ministry of Science and ICT (for research and technology), depending on the purpose. The United States has pointed out Korea’s LMO quarantine procedures as non-tariff barriers for several years through the ‘Country Trade Barriers Report (NTE)’ published annually. As the Trump administration announced that it would prepare a report analyzing each country’s non-tariff barriers for the purpose of imposing reciprocal tariffs by April, there are speculations that the opening of LMO agricultural product imports may also come up for negotiation. However, an official from the Ministry of Agriculture, Food and Rural Affairs said, “The ‘LMO issue’ is something that comes up in the NTE every year,” and “There has been no official request or mention from the United States regarding this.” [Terminology] GMO·LMO Genetically modified organisms (GMOs) are organisms whose genes have been artificially manipulated, including agricultural products that are in a state where they cannot reproduce or multiply. ‘LMOs with reproductive and breeding capabilities’ are capable of reproduction and can be used as seeds.
